PURPOSE:
This bill would allow adopted adults to learn who their birth parents
are when they reach the age of 21, subject to a contact veto filed by
the birth parent.

SUMMARY OF PROVISIONS:
Section 1 of the bill adds a new section 4138-e to the public health law
which sets forth the adoptee bill of rights. Among the rights is the
ability to receive an uncertified copy of their original birth certif-
icate at age 18. This section also allows a birth parent to file a
"contact veto," precluding a contact by an adoptee. The birth parent may
rescind the veto. This section also directs the Governor to set up a
voluntary citizens task force to assess the progress of the program and
report the findings to the legislature.
Sections 2 - 6 of the bill amend section 4138 of the public health law,
which governs the issuance of birth certificates, so as to allow an
adult adoptee to have a birth certificate reflect original data; include
any name changes to the adoptee; reflect current addresses; and requires
the department of health to accept additional data and information
supplied by birth relatives, which data must be provided to the adoptive
parents of minor adoptee and directly to adoptee over the age of 18.
Sections 7 and 8 of the bill amends domestic relations law section 114
so as to enumerate additional data to be transmitted to the department
of social services. These amendments also comport the DRL to the PHL in
that the right to an uncertified birth record is included in section 114
of the DRL.

EXISTING LAW: There is no existing proprietary right to birth data by
adoptee.

JUSTIFICATION:
Under New York law adoptees are unable to obtain birth records since
these are sealed. This means that adoptees are prevented from obtaining
medical information relevant to their own physical health. Further
adoptees are denied data with regard to their ethnic and religious
heritage. Lastly, they are denied knowledge of their family history.
Advances in medical care and the need for early intervention to help
prevent many diseases, access to data fulfills a necessary medical func-
tion. In addition, changing social values and the acceptance of
adoption has been a long and arduous process, with adoption receiving
greater acceptance and adoptees no longer being stigmatized. These
medical and social strides underscore the need for information.
In addition, with the advent of the internet and other research tools,
location of birth parents has become less difficult. Opening the proc-
ess is a logical step in the acceptance of adoption as an alternate
means of becoming a parent and at the same time allows adoptees the
opportunity to learn the basic facts of their own existence.

EFFECTIVE DATE:
This act is to take effect one year after it becomes law, except that
immediately, the commissioner of health must promulgate rules and regu-
lations as may be needed to implement the new statute.

Adoptees have civil rights and constitutional rights equal to all other citizens of this county and all other citizens when reaching the age of emancipation do NOT NEED THE PERMISSION OF THEIR PARENTS to obtain their ORIGINAL BIRTH CERTIFICATES.
Senators need to be made aware that adoptees will not settle for an open records bill that contains a CONTACT VETO CLAUSE.!!!!
